Privacy Policy

The Spanish version of this document is the only binding one. Translations into other languages are provided to aid comprehension and, in the event of any discrepancy, the Spanish text prevails.

In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (the General Data Protection Regulation, hereinafter «GDPR») and Spanish Organic Law 3/2018 of 5 December on the Protection of Personal Data and Guarantee of Digital Rights (hereinafter «LOPDGDD»), this Privacy Policy describes how LIVO HEALTH, SL collects, uses, stores, shares and protects the information arising from the User's use of both the platform accessible through the Website, www.getlivo.com, and our mobile Applications. The Website and the mobile Applications are jointly referred to hereinafter as the «Livo Platform».

By providing personal data through the Livo Platform, the User expressly consents to LIVO HEALTH, SL processing that data on the terms of this Privacy and Data Protection Policy clause and for the purposes set out here.

Identity and contact details of the Data Controller

In accordance with the GDPR, the User is hereby informed that LIVO HEALTH, SL, with its registered office in Barcelona (08022), C/ Ciutat de Balaguer, núm. 50, 4-3, and holding CIF no. B44862860 (hereinafter «Livo»), acts as the Data Controller of the personal data provided to us, which will be incorporated into a record of processing activities that it owns.

Personal information we collect

We handle your personal data in order to provide the services you have requested through your interactions with our Platform. That data may include, by way of example and without limitation, the following:

  • When you visit the Website, regardless of whether you subsequently contact us through the contact form, we automatically collect certain information about your device, including information about your web browser, IP address, time zone and some of the cookies installed on your device. In addition, as you browse the Website, we collect information about the individual web pages or products you view, the web pages or search terms that referred you to the Website, and information about how you interact with it. We refer to this collected information as «Device Information».
  • Livo makes mobile Applications available to Users in order to bring qualified professionals holding a nursing qualification together with Companies seeking staff. In that respect, it may also collect the following personal information from the User: first name and surname; NIF/NIE, postal address and email address; telephone number; date of birth; academic and professional details, such as curriculum vitae, work experience, qualifications or professional certificates; bank details; other official documents such as a driving licence or others that are relevant; applications to job offers; job offers sent; search requests; geolocation data, in order to display job offers near your location, and so on.

For what purpose do we process your data?

Personal data will be collected and processed in the context of the services offered through the Livo Platform for the following purposes:

  • Managing registration as a User, so that you can access our Platform and benefit from Livo's services, administering your user account.
  • Account and profile configuration.
  • Managing the requested service.
  • Applying for work shift offers and communicating your data to the company offering the shift, on the legal basis of your consent.
  • Sending important and necessary communications relating to the provision of our services.
  • The contact form, through which you can get in touch with us and send us questions, queries or requests.
  • Providing Users with information or advertising relating to our products or services.
  • Producing statistical reports on the profile of Users based on their access habits and the activity carried out on the Livo Platform, where applicable, in accordance with our cookie policy, in order to develop and improve how Livo works.
  • Preventing abuse and fraud in the use of our services.

What is the legitimate interest for processing your data?

The legal basis for processing the data is (i) performance of the «Terms and Conditions», where processing the data is strictly necessary in order to use the Livo Platform and therefore to allow the User to benefit from the services made available to them; (ii) the consent given by the User, which may be withdrawn at any time by contacting us at data@getlivo.com.

How long will we keep your personal data?

Livo will keep the User's personal data for as long as they remain registered as a User on the Platform and, beyond that, we will keep it until both the periods for which applicable Laws require us to retain it have elapsed and, duly blocked, the limitation periods for any legal actions for which that personal data or the documents containing it might be relevant.

Who will your data be disclosed to?

Livo will only share or provide your data to third parties to the extent that this is necessary and is permitted or mandatory under current legislation. In this respect, your data may be disclosed:

(a) In the case of applying for work shift offers, candidates' data will be visible to the company whose selection process they have applied to.

(b) We may disclose your personal data to public bodies, law enforcement bodies, courts and tribunals, tax authorities and regulatory bodies where required in accordance with legal and regulatory provisions, where necessary to comply with our legal obligations or with a legally binding requirement or request, and in those cases where it is necessary in order to respond to proceedings brought against Livo.

Accuracy and truthfulness of the data provided

The User undertakes to provide real and truthful personal data, and to notify Livo of any change or update to it. The User shall be solely responsible for the truthfulness of their personal data.

International transfers of personal data

No international transfers of data will be made to third countries outside the European Union (EU). However, should any be made in the future, you will be duly informed and all necessary safeguards required by data protection legislation will be put in place.

Security measures

Livo informs the User that their data will be protected with technical and organisational security measures to guarantee the security of personal data and thereby prevent its alteration, loss, unauthorised processing or access, taking into account the scope, the nature of the data stored and the risks to which it is exposed.

What are your rights as a data subject?

The User may exercise the following data protection rights in relation to Livo:

Right of access (art. 15 GDPR)

You may obtain confirmation as to whether your personal data is being processed and find out what personal data Livo processes.

Right to rectification (art. 16 GDPR)

You may correct the personal data Livo processes where it is inaccurate, and complete it where it is incomplete.

Right to erasure (art. 17 GDPR)

You may request that Livo delete your personal data where, among other grounds, it is no longer necessary for the purposes for which it was collected.

Right to restriction of processing (art. 18 GDPR)

You may request that Livo restrict the processing of your personal data in the following cases: (i) while a challenge to the accuracy of your data is being verified; (ii) where the processing is unlawful, the User objects to the erasure of their data and requests that its use be restricted; (iii) where your data is not being processed but is necessary for the exercise or defence of claims; (iv) where the User objects to the processing of their data for the performance of a task carried out in the public interest or to pursue a legitimate interest, while it is verified whether the legitimate grounds for processing override their interests.

Right to data portability (art. 20 GDPR)

You may request that Livo provide your personal data in a machine-readable format and transmit that data to another entity.

Right to object (art. 21 GDPR)

You may request that Livo not process your personal data for certain specific purposes, unless legitimate grounds, or the exercise or defence of possible claims, override that request.

To exercise the rights referred to above, the User may contact Livo by sending a letter to the postal address at Barcelona (08022), C/ Ciutat de Balaguer, 50, P.4 PTA. 3, or by email to data@getlivo.com, providing proof of identity by means of a photocopy of their national identity document (DNI) or an equivalent document evidencing their identity, together with the right or rights they wish to exercise.

If the request does not meet the specified requirements, Livo may ask for it to be corrected. No payment will be required for exercising the rights available to you. Rights will be granted provided there is no legal or contractual obligation to retain the data.

If you consider that data protection legislation has been infringed in the processing of your personal data, the User is informed that they may lodge a complaint with the supervisory authority (in Spain, the Agencia Española de Protección de Datos, Madrid (28001), C/ Jorge Juan, 6; www.aepd.es; telephone 901 100 099 and 912 663 517).

Amendment and updating of this information

Livo reserves the right to amend the present terms of its Privacy Policy in accordance with the legislation applicable at any given time. Any amendment will be included in these terms and published on the Website and/or mobile Applications, to which all Users will have access.

This Policy may be updated periodically. We recommend consulting it from time to time.
